#110 : Un assassin dans la nuit (1/2)

Harper Anderson téléphone à la police pour porter plainte. Elle vient d'être violée par un homme qui est entré chez elle et l'a menacé avec un pistolet. Benson n'est pas convaincue qu'Harper ait dit la vérité. Un homme est arrêté mais relaché, fautes de preuves. Six mois plus tard, selon le même scénario, une autre femme est violée. Benson croit alors Harper et le dossier est réouvert.

(Scene opens in Harper Anderson's bedroom.  The camera pans past the bed and stops on Harper, who is sitting in a chair, smoking a cigarette.  Harper picks up the phone and dials 9-1-1)

911.  What is your emergency?

Harper Anderson
I've just been raped.

(Cut to a beeper going off.  The camera pans to the bed to reveal Benson and Cassidy.)

Benson
(looks at her beeper)
Uh — that's me.
(kisses Cassidy)
Gotta go.
(climbs out of bed)

Cassidy
Whoa, whoa, whoa, where are you going?  Hey, hey —
(trying to get Benson's attention)

(lays back down)

(tying her robe)

(sitting in a chair, alone)

Benson
Hi, I'm Detective Benson.

Harper Anderson
(shakes Benson's hand)
Harper Anderson.  It's nice — um, it's not really nice to meet you.

Benson
I know.  How long have you been waiting?

Harper Anderson
Um, 45 minutes.

Benson
(looking around)
And where's the officer that brought you in?

Harper Anderson
I sent him to the cafeteria.  He was getting on my nerves.

Benson
I'm going to ask you for a formal statement later, but in order for us to do the exam, Miss Anderson, I —

Harper Anderson
Harper.  Please.  Just talk to me.

Benson
Okay... I need you to describe the assault.

Harper Anderson
Um... He, uh — he grabbed my ankles.  He grabbed my wrists.  He hit the side of my face.

Benson
(taking notes)
Did you lose consciousness?

Harper Anderson
No.

Benson
Did he penetrate you?

Harper Anderson
Vaginally.  That's it.

Benson
Did he use a condom?

Harper Anderson
He, um — he ejaculated on my stomach, and then he wiped it off with one of my shirts.

Benson

Harper Anderson
(shaking her head)

(gets up and walks over to the nearest doctor)

ER Doctor

(Cut to a close-up of Harper — a camera flashes, Harper blinks.  Then there are a series of shots showing the bruises left by Harper's attacker — a picture is taken of each one)

— 1:03 a.m. —

(Shot of Harper swabbing her mouth for a DNA sample — she hands the swabs to the doctor, who rubs the sample on a slide and puts the swabs in a box — both are dumped into an envelope being held by Benson)

(Close-up of the doctor scraping underneath Harper's fingernails — Harper is looking worn out; Benson looks over to see if she is okay)
 


 

— 1:47 a.m. —

(Cut to Harper lying down and the doctor taking more samples for the rape kit)

Benson
Oral swabbing, fingernails, you combed her pubic hair, took vaginal swabs, and did blood work.
(takes a swab from the doctor and hands him another one)
I'll bag this, and — uh — we need to do a UV on her stomach.
(Benson is rubbing the swab on another slide)

ER Doctor
A what?

Benson
Uh, we need to do a UV light and check for semen on her stomach.

ER Doctor
We don't have one.

Benson
It's a small box.  It's about 8x2.  Looks like a hardback book with a cover.

ER Doctor
I know what it is.  We don't have it at this facility.

(Harper moans and grabs her forehead)

Benson
Just forget it — he made her take a shower anyway.
 


 

— 2:11 —

(Shot of the doctor filling a small cup with water from the sink)

ER Doctor
This is Ovral.  It will, as we discussed, prevent pregnancy, in case —
(hands Harper the pills and the cup)

Harper Anderson
I know, I know.
(takes the pills)

ER Doctor
You need to take two more in 12 hours.  We'll have your STD and AIDS test results back within 24 hours.  You'll need to retest at the three- and six-month marks.

Harper Anderson
Who's — um — paying for all this?

Benson
The state is.

Harper Anderson
What else?

Benson
I'm gonna need to get a formal statement from you, but if you're too tired now and you want to go back to your apartment —

Harper Anderson
I just want this to be over with.

Benson
Okay, I can take you down to the station right now, if you're ready.

Harper Anderson
(nods)

(Cut to Stabler talking with the doctor)

Stabler
What'd you find?

ER Doctor
No real signs of trauma.  The blow to her face could've been much worse.  The guy used the least amount of force possible.  He ejaculated on her stomach, then made her take a shower, so our DNA chances are —

Stabler
Slim.

ER Doctor
If that.

Police Officer
(walks up to Stabler and the doctor)
You guys here about the stranger rape?

Stabler
Yeah.
(looks at doctor)
Thanks.

Police Officer
Yeah, I was in the cafeteria, and when I came back —

Stabler

Police Officer
She asked me to.  I figured she'd been through enough.

Stabler
I don't care if she pushes you away.  You don't leave a rape victim alone.

Stabler
Okay.  The crime scene?

Police Officer
Secured.  We just need to know what to look for.

Stabler
Alright, my partner and I are gonna take her to the station and get a statement from her.  Can you voucher the rape kit?

Police Officer
I'll take it straight to the M.E.

Stabler

— 3:45 —

(Harper, Stabler and Benson are in a room at the station)

Stabler
You sure I can't get you anything to eat?
(Sets a cup of coffee in front of Harper)

Harper Anderson
No. Thanks.

Benson
(sits down and grabs her notepad and pen)
So, Harper... Tell me what happened from the beginning.

Harper Anderson
Um, there was a street fair that night.  I guess that would be last night — which is still tonight.  Um, it was loud, so I put earplugs in.  I couldn't hear anything.  I woke up, and... there was this guy — standing there staring at me, holding one of my shirts in his hand.  He told me to shut my eyes.  He told me he had a gun.  He got on top and jammed his knees on either side of my legs to keep them closed.  It happened so slowly... but I looked at the clock.  The whole thing took 42 minutes.  He, um, took my nightgown and shoved it over my head.
(moving her arms to illustrate what happened)
My arms got tangled in it.  He-he took my ring.  
(pauses to regain composure)
The gown was over my face.  Over my eyes — he had stretched it — tight over my eyes.  He kept pushing it up so the bottom half of my face was showing.  Then he tried to kiss me.  I jerked away.  That's when he hit me.
(pauses)
I should have kicked him!  I should have run away!

Benson
If he had a gun, you didn't have a chance.

Stabler
What'd he do next?

Harper Anderson
I heard him unzip his pants.  When he was ready, he moved hard, five times.  He said, “Is this the way you like it?”  And he ejaculated on my stomach.  He told me I was gonna have to take a shower.  So he got off me, he zipped up his pants, he told me to get up.  And then he said... he said, “Please.”  So I got up, I walked across the room.  My arms were still over my head, in my gown, and I was cold.  He ran the water.  He asked me if it was too hot.  It was, so... he adjusted it till it was just right.  And then he gently... took off my gown so I could see to get in.  And then he washed me.  He told me I had pretty hair.  He touched my stomach, he... he touched everything.  He handed me a towel, he handed me the robe.  He told me to get on the floor, and look away — “Count to 20.” He said he wasn't going to insult me... by asking me not to call the police.  Thoughtful, wasn't it?

(Harper and the detectives are still discussing the rape)

I didn't see it.  But he held it to my head when — when he caught me looking at him in the shower.

What'd he look like?

Harper Anderson
Tall, thin.  White.  Sandy hair.

Benson

Harper Anderson
Cold.

Stabler
How tall?

Harper Anderson
I don't know.  Tallish.

Benson
How old do you think he was?

Harper Anderson
Around my age, I guess.  Like someone I would know — someone I'd hang out with.

Benson
Did you know him?

Harper Anderson
No.

Stabler
Anything unusual happen that suggests something like this might happen?  Strangers around the neighborhood, odd phone calls?

Harper Anderson
No.

Stabler
Was he nervous?

Harper Anderson
No, he wasn't nervous.

Benson
What did he smell like?

Harper Anderson
Um, he was wearing cologne.  Subtle, not cheap.

Stabler
Could you identify him in a lineup?

Harper Anderson
Absolutely.

Stabler
He took your ring.  Could you describe that for us, please?

Harper Anderson
(drawing a picture of it)
Um, it-it's very rare.  Platinum.  It has a small branch with diamond leaves curling over the band.  It was my grandmother's.

Benson
Did he take anything else with him?

Harper Anderson
Um, my wallet.  It was on the dresser next to my jewelry box.

Benson
You said that he wiped your stomach with a shirt.  Did he leave that behind?

Harper Anderson
No.  He must've taken it from the drawer before.  My “Rosie the Riveter.”  You know, the girl flexing her bicep — “We can do it”?

Harper Anderson
Near the restaurant where I wait tables.

Stabler
What Laundromat do you use?

Harper Anderson
(sighs and slumps over the table, exhausted)

Benson
Can I get you anything?

Harper Anderson
(head still on the table)

Benson
(setting her notepad and pen on the table)
Okay, we are done.  Thank you.

Harper Anderson
What now?

Stabler
Well, we can drive you to a friend's, or if you have family in town...

Harper Anderson
No.  I guess I'll go to my boyfriend's.

Benson
Have you called him yet?

Harper Anderson
No.  I didn't, um — I don't know what to say.
 


 

— 7:01 a.m. —

(Cut to Benson walking Harper to her boyfriend's apartment building)

Harper Anderson
I got it from here.

Benson
Oh, okay.  I'm going to meet my partner at your apartment.

Harper Anderson
(reaching to remove her coat)
Oh, um, tell him thanks for the coat.

Benson
Sure.  The place is gonna be a mess when we're done with it, but at least we'll be done soon.

Harper Anderson
Great.

Benson
The State is gonna pay for a locksmith to change the locks in your apartment — that's standard procedure; I'll give you the keys.  Uh — also, a counselor will be calling you today to set up an appointment.

Harper Anderson
Also standard procedure?

Benson
Yeah.
(taking a card and writing her number on it)
This is my pager number.
(hands it to Harper)
Call me anytime, day or night... I mean it.

(Harper nods her head)

Benson
Do you want me to come up with you to talk to your boyfriend?

Harper Anderson
No, no.

Benson
Okay.

(Benson starts walking away, stops and turns back to look at Harper.  Harper sees her and gives her a little smile before stepping into the building.
 


 

(Cut to Benson entering Harper's apartment — sees Cassidy)

Benson
Hey.

Cassidy
Hey.

Stabler
I didn't know how long you'd be, so I thought I'd call him in.

Benson
Find any prints?

Stabler
No.

Cassidy
No.

Benson
Well, how'd he get in?

Cassidy
Window, off the fire escape.

Stabler
This one doesn't lock.  And from the looks of things, it hasn't for a while.
(pushes open the window)
See that?  Afterwards, he lets himself out through the front door.  Okay, so, he comes in through the window, sees her sleeping.

Cassidy
You said he pushed her nightgown up?

Benson
Yeah, and...

Cassidy
Well, how did she see the clock?

Benson
Before — and after.

Stabler
He takes her wallet, then he grabs one of her t-shirts.

Cassidy
(picks up a joint off the dresser)
Maybe she gets high.
(holds it so Benson can smell it, before putting it back)

Stabler
Maybe he was high?

Benson
He wouldn't have had the time.  And, Harper didn't mention him smoking anything.

Stabler
She didn't mention the pot at all.

Benson
Well, let's check for saliva — see if there's two types of DNA.

Stabler
At this point, he immobilizes her, takes her ring and rapes her.

Cassidy
We still haven't found the underwear that she was wearing.

Benson
You think he took that too?

Stabler

Benson
Maybe... Then he takes her to the tub.
(walks over to the bathtub)
Shower curtain's wet.

Cassidy
Soap's not.

Benson
No, I know where you're going with this.

Cassidy
Look, women who stage rapes will wet the shower curtain, but they'll forget the soap.

Benson
Harper didn't stage this.

(Bends over to pick up the curling iron lying on the floor and holds it up to Benson's head)

Right now, there isn't enough evidence to suggest it didn't.

There isn't much evidence at all.

Cragen
Well, it is still an open case, so let' s proceed, okay?  The victim lived in the second floor unit.  Point of entry?

Stabler
Window, off the fire escape.

Cragen
So, we're looking for a stranger.

Munch
Someone who doesn't have access to the building.

Cassidy
No fingerprints.

Benson
No DNA.

Cragen
(sarcastically)
Well, that's a start.  Got a profile?

Benson
White, 30-something, sandy hair, approximately 5'8”.

Stabler
She was hit on the left side of her face, so the guy we're looking for is probably a righty.

Narrowing our suspect pool down to 80% of the population.

She said that he smelled subtle, which means expensive.

Probably not a junkie looking to score.

Stabler

He was careful not to leave any evidence behind.

Well, then our guy would match other open MO's.

Benson
Unless Harper's his first victim to report a rape.

This guy tried to kiss her, wanted to know if she liked it, said “Please.”  I mean, in his fantasy world, he's the perfect gentleman.

A power rapist.

Benson
A real charmer.

Cragen
You know, Harper lives at 101 Moore Street.  There was a Halloween carnival going on right below her window.

Cassidy
I'll run a license check on the vendors, check for priors.  And if he went up the fire escape, then maybe we've got a witness.

Munch
I'll check pawn shows and look for a leafy platinum ring.

Cragen
(to Stabler and Benson)
You got to go back to Harper — ask her about the drugs.

Cassidy
Uh, the pot makes me nervous.

Benson
Well, we're not going to bust her on that.

Cragen
Canvass her neighbors.  Talk to the super.  See about recent break-ins.  Ask about gentlemen loiterers, but first, talk to Harper.  If she's lying, you'll know.  Gut feeling is your best guide.

Smoking pot is not a part of my routine.  I — I had a job interview.  I was just trying to mellow out.  Nothing that happened last night is part of my routine.

Benson
We just need to be thorough.

(storms back inside)

The city's gonna pay for this, right?

Benson
It'll be taken care of.

Super
Yeah?  I'll tell you, nothing like this ever happened as long as I've been here.  We've had a few domestic incidences, there was a dead body in the dumpster once.  But nothing, never like this.

Stabler
Yeah, have you noticed anyone lately who doesn't belong here?

Super
No.

Benson
What about maintenance?  Workmen, meter readers?

Super
No.  Ask the tenants.  See what they saw.  I'm sure I'm gonna lose some over this.
 


 

(Cut to Benson and Stabler talking to an older woman through her apartment window)

Older Woman
I didn't see anything, but I know someone who did.
(Points to apartment building across the street)
Look — second window on the left.

(Benson and Stabler look and see a man watching them through his window.  He realizes that the detectives saw him and closes the curtain)
 


 

(Cut to the detectives at the door of the man's apartment building)

Benson
(on the phone)
Uh-huh.  Great.  Thanks.
(hangs up)
“Triple-I” on Sam Lardner.  Three previous callers for trespassing.

Stabler
I wonder if last night makes four.
 


 

(Cut to the detectives inside Sam Lardner's apartment)

Benson
Harper Anderson.  About 5'6”.  Long blonde hair?

Sam Lardner
No, no sorry.  No, I don't know her.

Stabler
She's single, lives alone.
(goes over to the window, pushes back the curtain, and points to the Harper's apartment)
Yeah, she lives in this building, right there.

Benson
It's a great apartment.  It's got red walls, just there on the third floor.

Sam Lardner

Stabler

(Sam shakes his head and is speechless)

(gives Sam a look)

Hey, I've been cross-checking Harper's CSAAT — you know, looking for victims who used her hair salon, her grocery store, her dry cleaners.

Stabler
You find anything?

Jeffries
Well, I found victims at each place, but none of their attackers had similar signatures.

Cragen
You think Harper is the kind of woman that would buy $500 worth of hand-packed meats?

Benson
Not even if it was on sale.

Stabler
Someone used her credit card.

Cragen
Munch and Cassidy are bringing the suspect over from the two-seven.
 


 

(Cut to Munch and Stabler bringing the suspect in)

Munch
This is Ron Johnson.

Stabler
Yeah, the meat lover.

(Benson follows them and Cassidy catches up to her; Stabler, Munch, and the suspect keep walking)

Cassidy
Hey, Olivia.
(handing Benson her watch and lowering his voice)
You left this behind last night.

Benson
(taking the watch)
Oh right, great.  Thanks so much.
(starts to walk away)

Cassidy
(grabs her arm)
Whoa, whoa, whoa, wait, wait, wait, wait.  I um — I want to see you again.

Benson
(keeping her voice low)
Um, Cassidy... we went to Maloney's, we got drunk.  And I wanted it to happen as much as you did, but that's all I wanted to happen.

Cassidy
(upset)
This is about what happened in Harper's apartment, right?

Benson
No, no it's not.

Cassidy
My doubting — not doubting, but my questioning you, and questioning Harper — I mean, that was just a job.  I mean, it wasn't personal.

Benson
And you know what?  Neither was last night.
(walks off)
 


 

(Cut to Stabler at his locker — Benson meets up with him)

Benson
Where's the meathead?

Stabler
Interrogation.

Benson
500 pounds of meat.

Stabler
You think he'd be a little more creative.

Benson
Yeah, buy a DVD player or something.
(opening her locker)

Stabler
Or even lottery tickets.  Up his chances.

Benson
Can you imagine if that guy won the lottery?

Stabler
You know, I can.
(closes his locker and turns to Benson)
How long have you been sleeping with Cassidy?

Benson
(caught off guard by Stabler's question)
Uh, I'm not.

Stabler
Your stomach just dropped two floors, Olivia.  The unconscious doesn't lie.

Benson
(closes her locker)
I'm not lying... Not much.

Stabler
Um-hmm.

Benson
Is it that obvious?

Stabler
I'm your partner.  For better or worse.  Look, everybody knows too much about everybody else in this office, anyway.

Benson
I broke a rule, Elliot — a personal one, and now he wants to see me again.

Stabler
Can you blame him?

Benson
I just — I can't do it right now.  I didn't — I didn't mean for this to — I mean, I guess you never do, but I —
(stops and rolls her eyes)

Stabler
Sometimes you do.  Be nice to him — maybe even over-nice.  He'll be cold, but he'll get over it.  It happens.

Benson
Really?

Stabler
Really.  Cragen's waiting for us.
(walks away)

(Cut to the detectives inside the interrogation room)

Benson
What time did you get up?

Ron Johnson
I don't know, 11?

Stabler
What'd you do then?

Ron Johnson
Uh, had a bowl of cereal, took a shower, and then kinda, you know, walked around.

Stabler
Where'd you “kind walk around”?

Ron Johnson
You know, around.

Stabler
What'd you do then?

Ron Johnson
Hung out.

Benson
Yeah, what did you do last night?

Ron Johnson
Look, what's the big deal?

Stabler
The “big deal” is that last night a guy who looks an awful lot like you —

Benson
Who also had nothing better to do —

Stabler
...broke into a woman's apartment and raped her.

Ron Johnson
Whoa, whoa, whoa, whoa, whoa, I did not rape anybody!

Stabler
You were using her credit cards.

Ron Johnson
Look, I've done a lot of things, but I've never done that.  Last night I was in a holding cell.

Benson
What for?

Ron Johnson
I jumped a turnstile getting on the “1-9”.

Benson
What time did you get out?

Ron Johnson
I don't know, like, 1 a.m.

Stabler
Where'd you get her credit cards?

Ron Johnson
I found a wallet in a garbage can.  Corner of Moore Street.  It had been picked clean of cash.  Look, I took that wallet, but I never never raped anyone.
 


 

(Cut to Benson, Stabler, and Cragen in the squad room)

Benson
(looking at some papers)
His arraignment's not here.

Cragen
(looking at his watch)
What time did you get that printout?

Benson
Around 5:30.  Why?

Cragen
Because they update the records every day —

Benson
At 6 p.m.

Cragen
6 p.m.

Stabler
(pointing at the computer screen)
Look, there it is.

Benson
Damn.
(throwing the papers in the air)
That's the best lead we had.

Stabler
No DNA, no fingerprints, that's the only lead we had.

Cragen
Uh, look, I've got paperwork coming out my ears.
(walks away)

Stabler
We're looking at a dead case here.

Harper Anderson
Detective Benson?

Benson
Harper.
(gets up and walks over the Harper)

Harper Anderson
(looking nervous and looking around)
Where is he?

Benson
We don't have him.

Harper Anderson
But you said —

Benson
We were wrong.  I, uh — I'm so sorry.

(Harper sighs, looking very disappointed)

Benson
(reaches over and grabs some keys out of her desk drawer)
We changed the locks on your apartment.
(hands Harper the keys)

Harper Anderson
So he's still out there?

(Benson looks at her, kind of nods, but doesn't know what to say)
 
 

APARTMENT OF HARPER ANDERSON
101 MOORE STREET
MONDAY, NOVEMBER 1
SIX MONTHS LATER
 

(Scene opens in the squad room.  It's night and Benson walks in dressed like she is going out on a date)

Cassidy
(sitting at his desk, sees Benson)
You look nice.

Benson
Oh, thanks.

Cassidy
Going out?

Benson
Yeah.
(bends over to look into a computer screen while applying some lipstick)

Cassidy
You know, six months ago, you didn't have time for a relationship.

Benson
(looks up)
Oh, come on, Bri — it's not you.

Cassidy
Yeah, obviously.

Benson
No, it's a personal policy.  You don't fall in love with people you work with, no matter how great the sex was.

Cassidy
So now you're in love?

Benson
I don't know — if I'm lucky, yeah.

Cassidy
You'll be bored out of your mind.

Benson
I'll still have my job.

Cassidy
Yeah, well, whoever you marry —

Benson
If I get married.

Cassidy
Whenever you will.  As long as you have this job, your marriage will be an affair.
(Benson stands there, speechless)

Cragen
Benson, can I see you for a minute?  I really think you want to hear this.

(Benson takes one more look at Cassidy and follows Cragen into his office)

Cragen
Detective Benson, this is Detective Halligan. Robbery, the three-one.

Benson
(Benson walks over and shakes the detective's hand)
How are you doing?

Cragen
I want you to listen to what he just told me.  Four days ago, a guy breaks into an apartment, and finds a woman alone.  He's wearing a mask, tells her that he has a gun.  He whacks her a couple of times then pushes her down onto the bed.  But, he's real polite, saying “Please,” stuff like that.  Only, to his surprise, she has a gun hidden between the mattresses.  She pulls the gun on him, flips on the lights, what was he using for a gun?
(points at Benson)

Benson
A curling iron.

Halligan
She's holding a .22, he's holding her curling iron.

Benson
It's Harper's guy.

Cragen
Maybe.

Benson
(talking to Detective Halligan)
We had a similar case about six months ago — a rape case.  Did she shoot him?

Halligan
She froze up.  Guy stumbles down the stairs.  Last she sees, he's limping down the street.  That's when we picked him up.

Benson
Could she ID him?

Halligan
(shakes his head) We even had her close her eyes, had the guy saying “Please,” but nothing.

Benson
Well, where is he now?

Halligan
He's out.

Benson
Out?

Cragen
Yeah.  The guy didn't have a mask, didn't have any gloves on him.  Had a fantastic lawyer.
(hands a file to Benson)

Halligan
That's just it — this West Village guy has enough money that he has a lawyer on retainer.  But why the “B and E”?

Benson
(looking at the file)
This is the same neighborhood as Harper — Tribeca, same MO.  He came off the fire escape, used a curling iron instead of a gun, he said, “Please.”

Cragen
Only this time he used a mask.  He's getting better.

Benson
And more violent.

Halligan
But he didn't rape this woman, Jane Tyler.

Benson
(shakes her head)
In my gut, I know it's him.

Halligan
His address is right in that file.

Cragen
We're gonna have to get an ID from Harper Anderson.
(stands up and walks over to Benson)
Look, before we bring him in, I want you to get a statement from Jane Tyler.  Make sure that the MO matches up as much as you think it does.  We don't have any forensics on this guy.

Benson
(nods)
Okay.
(starts to walk away)

Cragen
You know, this really could wait till morning.

Benson
(stops, looks at Cragen)
My guess is she's not sleeping.
(walks away)
 
 

APARTMENT OF JANE TYLER
203 LEONARD STREET
WEDNESDAY, MAY 3

 

(Scene opens to Jane Tyler sitting on the couch talking to Benson.  Jane has a pretty nasty bruise on her left eye)

Jane Tyler
And I'm sitting there holding this gun on him, and I can't — even after everything he did to me... I can't pull the trigger.

Benson
That's okay.

Jane Tyler
He took off through the front door.  That's when I managed to call 911.  He took my father's watch.  It had his name on it — “Leo.”

Benson
That isn't in your police report.

Jane Tyler
I know, uh — they got here and I couldn't talk.

Benson
Jane, what else isn't in your police report?

(Jane starts to cry and looks down at the floor; Benson gets up from the chair and walks over to sit on the couch next to Jane)

Benson
Did he rape you?

(Jane nods)

Benson
Did he use a condom?

Jane Tyler
No, he, uh...

Benson
Did he ejaculate on your stomach?

Jane Tyler
Yes.  He made me take a shower.  I — I told the police that I had just gotten out of the shower when I found him.

Benson
Why wasn't the rape in your police report?  That, or the watch?

Jane Tyler
(shakes her head)
The police were touching everything, looking for fingerprints and I wanted them gone.  It was so embarrassing.  He kept saying — “Isn't this how you like it?” when he was pushing inside of me.  I bought that gun for self-protection, and I didn't even —

Benson
Jane... you did the one thing that you're supposed to do when somebody threatens you.  Survive.

(Jane looks at her and starts crying again)
 


 

(Cut to Benson and Stabler climbing the stairs to Kenneth Cleary's house — it's obvious the guy is rich)

Stabler
You sure this is the right address?

Benson
(rings the doorbell and pulls out her notepad)
This is the address he gave police.

Mrs. Cleary
(opens the door)
Hello?

Benson
Hi, we're looking for Kenneth Cleary?
(shows the wife her badge)

Mrs. Cleary
(looks at the badge)
Kenneth!

Kenneth Cleary
(walks into the doorway with his son)
I'm Kenneth.

Stabler
This is Detective Benson, I'm Detective Stabler -

Benson
Elliot, her ring.

(Camera zooms in to get a shot of Mrs. Cleary's ring — it is Harper's ring)
 


 

(Cut to the detectives and Kenneth Cleary in the interrogation room)

Kenneth Cleary
I'm just such a klutz.  I just stepped off the curb and my ankle went right out from under me.

Stabler
What were you doing on Leonard Street at 2:45 in the morning?

Kenneth Cleary
Clearing my head.

Stabler
Mm-hmm.
(sits down at the table across from Cleary)

Kenneth Cleary
I've got a couple of accounts that are weighing me down.

Benson
Leonard Street's what, 18 blocks from where you live?

Kenneth Cleary
They're big accounts.

Stabler
You didn't try and clear your head at Jane Tyler's apartment?

Kenneth Cleary
I'm — I'm sorry, who?

Stabler
Beautiful woman, blonde — six months ago you did someone else?

Kenneth Cleary
Please.

Benson
(bends down and sniffs Cleary's collar)
What kind of cologne do you use?

Kenneth Cleary
Whatever my wife buys me.  I don't know the names.

Benson
Where did you buy your wife's ring?

Kenneth Cleary
(looks at Benson, then over at Stabler)
About that, I think I should probably talk to my lawyer.

Benson
Yeah, don't worry about it.  He's on his way down here.  So where'd you get it?

Kenneth Cleary
I probably shouldn't say.  I bought it on the street.  I knew it was probably hot, but I bought a Rolex from that guy before, so I thought —

Benson
(pointing to Cleary's watch)
What about your watch?

Kenneth Cleary
Been in the family for years.

Benson
May I see it, please?

Kenneth Cleary
(removing the watch)
Sure.

Benson
(takes the watch and flips it over to read the inscription on the back)
Who's Leo?

Kenneth Cleary
That's my astrological sign.

(Benson hands the watch to Stabler)

Stabler
(takes the watch and looks at it)
Who's your jeweler?

Kenneth Cleary
TJ.

Stabler
(amused)
TJ?

Kenneth Cleary
He's a black guy.  Sometimes he's on the sidewalk between Canal and Mott Street.

Stabler
Canal and Mott intersect.  He can't be between Canal and Mott.

(Cleary doesn't know what to say)

Stabler
Tell you what, why don't you just diagram it out for us where “TJ” is?
(hands Cleary a sheet of paper and a pen)
 


 

(Cut to the detectives talking to Cragen in his office)

Benson
He smells expensive.

Cragen
“Ladies and gentlemen of the jury, I ask you to smell the defendant.”

Stabler
Well, how many rapists do you know smell expensive?

Cragen
Well, depends where they shop.

Stabler
The watch, the ring — these are trophies from the victims.

Cragen
Victim.  See, we don't have two victims here, because only Harper reported her rape, and only Harper reported anything stolen.

Benson
But Jane told me -

Cragen
C'mon!  You know and I know that we are not going to re-open her case.  There's no forensic evidence and she can't ID him.  No jury will convict him.
(throws a file on his desk and sits down)
Alright, look... Cleary's wife was wearing Harper Anderson's ring.  So, right now we might be able to get him for possession of stolen property.  But without Harper's corroboration, we don't even have him on that.

Benson
She'll ID her ring, but more importantly, she said that she can ID Cleary as her rapist.

Cragen
Well, you better get her down here now, 'cause he has the right to a speedy arraignment, which in New York, thanks to a few very expensive lawsuits, means 24 hours.  And that 24 hours started at 9 a.m.
 
 

APARTMENT OF HARPER ANDERSON
101 MOORE STREET
THURSDAY, MAY 4

 

(Scene opens with the detectives knocking on Harper's door.  The door slides open to reveal the Super, not Harper, living there)

Benson
Where's Harper?

Super
She never spent another night her.

Benson
Well, when did you move in?

Super
A few months back.  I knew I couldn't rent the apartment to anyone else.

Stabler
You know where she went?

Super
No, she moved out so fast, I still have her security deposit.  She didn't leave a forwarding address.
 


 

(Cut to Benjy, Stabler, and Benson walking out of a building)

Benjy Dowe
I tried to be understanding — I did, really — but it got to the point where it couldn't work anymore.

Benson
Why?

Benjy Dowe
She stopped eating.  She lost her job because she hardly ever slept.  At first, she could only sleep during the day.  When she could finally sleep at night, every single light had to be on, which meant I couldn't sleep.  My boss was totally getting on my case.

Stabler
It must've been very hard for you.

Benjy Dowe
She couldn't sit through a movie.  She started working out like a fiend... dressing differently.  She always wore her running shoes — even when she would sleep — even under the covers.  I guess she thought that if she had them on that night, maybe she could've —

Benson
Did she see a therapist?

Benjy Dowe
She never shed a tear.  We never had sex again.  A few months ago, she broke up with me.

Stabler
You know where she went?

Benjy Dowe
(writes down the address)
New job, new place.  All new Harper.
 


 

(Cut to Benson and Stabler standing outside Harper Anderson's new apartment)

Benson
(knocking on the door)
Harper?
(No answer, knocks again)
Harper, it's Detective Benson.

(door opens and a whole new Harper appears — her hair is short, and she is dressed in a business suit)

Harper Anderson
I don't care what you want.  Don't ever come here again.
(slams the door)
 


 

(Cut to the Cragen, Abbie Carmichael, and Benson in Cragen's office)

Cragen
Cleary's wife was no help.  She always remembers him sleeping straight through the night.

Abbie Carmichael
Munch and Cassidy find out anything about this “TJ” at Mott and Canal?

Benson
There's not one TJ, there are five, and funny thing — they're all upstanding, tax-paying citizens who deal exclusively in electronics.

Abbie Carmichael
No jewelry.

Benson
No.

Cragen
And no knowledge of our Kenneth Cleary.

Benson
What about a warrant?  We'll search his place, maybe we'll come up with other trophies.

Abbie Carmichael
But there are no other victims.

Benson
I'm sure that there are.  We just don't know about them.

Abbie Carmichael
Exactly.  So, you don't know what to look for, so, I can't get you a warrant.

Benson
Isn't there some legal way that we can compel Harper Anderson to talk?  What about outstanding parking tickets or moving violations?

Cragen
Olivia!

Abbie Carmichael
I'm not going to rape her a second time, Detective.

Benson
That's not what I meant.

Abbie Carmichael
As it stands right now, we have no forensics on either rape.  And as far as the State is concerned, Jane Tyler's rape never even happened.

Cragen
What Cleary does have is Harper Anderson's ring.

Abbie Carmichael
But no priors, and a great lawyer who will plead Cleary out on his possession of stolen property.

Benson
Six months ago, Harper Anderson told me that she could “absolutely” ID her rapist.  Now, she won't even talk to us.

Abbie Carmichael
Then you'll have to use your own powers of persuasion, Detective, because I can't help you.

Cragen
Thanks, Abby.

Abbie Carmichael
(turns to Benson)
Sorry.

Benson
Thanks.

(Abbie walks out)

Cragen
Stabler is digging up anything he can on Cleary while Munch treads water with his lawyer, but they haven't given anything up.  Get his picture, put it into a photo array, get it to Harper.  Take Cassidy with you.

Benson
Okay.

Cragen
You know, it's almost midnight.  In a few hours, we let Cleary go.
 


 

(Cut to Kenneth Cleary and his lawyer, Jeff McClintock, talking to Munch in the interrogation room)

Kenneth Cleary
Aggressive accounting doesn't mean illegal accounting, although it does raise an eyebrow every now and then.

Munch
Aggressive accounting...

(Door opens and Stabler comes walking in, looking at some papers)

Stabler

Stabler

Jeff McClintock
You don't have to answer that.

Kenneth Cleary

Stabler
(looking at the papers)
Ah, no, his name is Percy.

Kenneth Cleary
Wouldn't you prefer Leo to that?
(turns to Munch)
Now, no wedding ring means you're either single or divorced.  Let's say single.  Let's say you have disposable income.  I could take that money, with the market like it is, get you 20%.

Munch
20%?

Stabler
You get to Tribeca a lot?

Jeff McClintock
You don't have to answer that.

Stabler
(turns to McClintock)
What questions can your client answer?

Anything that's a matter of public record.  I want to know what my client's being charged with.

Munch
You don't have to answer that.

(Jeff McClintock, Kenneth Cleary, and Stabler all look at Munch, Stabler is amused)
 


 

(Cut to Benson and Cassidy standing outside Harper's apartment; Benson is knocking on the door)

Benson
Harper, we need to talk to you.
(waits for an answer)
We're perfectly happy to stay here all night.
(turns and leans her back on the door)

Cassidy
I almost prefer homicides to rapes.

Benson
You don't have the relentless pain of the victim.

Cassidy
(whispers)
It's awful.

Benson
And it's not over.
(turns to the door again)
Harper, you know I'm just as stubborn as you are.

(The door opens)

Harper Anderson
Fine.

Benson
We've picked up a guy that raped a woman almost exactly the same way that you were raped.  Only this time, he was wearing a mask, so the woman wasn't able to make a positive identification.

Cassidy
All we need for you to do is take a look at this photo to see if it's the same man who also raped you.

Harper Anderson
I don't ever want to see him again.

Benson
Harper.

Cassidy
What about that other woman that he raped?

Harper Anderson
I don't care!

Benson
You are the only eyewitness that we have on this guy.  Other women, and there are other women, either haven't come forward, or haven't been able to ID him.

Cassidy
Without you, we don't have a case.

Harper Anderson
And what good is that supposed to do me?

Cassidy
Well, we could put him away for starters.

Harper Anderson
Is that gonna change anything for me?  Is that supposed to give me some sort of closure?  Because I've already made peace with what's happened to me.  I already did the one-on-one therapy, the yoga, I cut my hair, I lit a candle and guess what?  I'm over it!
(walks away)

Benson
God, what a mess.

Cassidy
I don't know... maybe he's not the guy who did her, you know?

Harper Anderson
(hears Cassidy's comment)
“Did” me?!  The guy who “did” me?!  He raped me, you ass!

Benson
Then why don't you do something about it?!

Harper Anderson
I did everything that I was supposed to do.

Benson
And you are obviously not fine!

Harper Anderson
Who are you to tell me that I am not fine?!

Benson
Because closure is a myth.  I've heard survivors -

That survivor stuff is crap!

Benson
I've heard them say, this is something that you never get over.

Harper Anderson

Benson
You think you're back to normal?  Then tell me, when was the last time you slept in your bed without wearing running shoes?

(Harper is speechless)

Benson
The truth is, everybody changes every day.  And some things are more devastating than others, but we never are the same.  And there are two ways to deal with these changes.  You either accept them, or you fight them like hell all the way.  Now please, come with us back to the station and just take a look at this guy.  It's gonna help you more than you know.

Harper Anderson
I don't want any more help.

Benson
Then come back with us for us.  I will be right there with you.

Harper Anderson
(takes a deep breath and nods her head)

(Cut to the line-up.  A cop opens the door and each man walks through in a single-file line.  Each man has taken his place and Harper steps up to the two-way mirror — Benson is right beside her)

Cragen
(walks to the side of the mirror and pushes the button)

Kenneth Cleary

(Harper looks at each man, looks at Benson, and shakes her head.)

Benson

Are you sure?

Harper Anderson

(Cut to Benson and Harper walking into the squad room — Benson motions for Harper to sit down)

Benson
Have a seat.
(They sit down)
Harper, I have something that I want to show you.

Harper Anderson
I'm so happy he wasn't in there.

(Benson shows her the ring and Harper is caught off guard)

Harper Anderson
Where did you get that?

Benson
From a man you couldn't identify.

Harper Anderson
He was in there?

Benson
I thought so.

(Harper breaks down and starts to cry)

Harper Anderson
I always thought that I would recognize the man who did this to me.  My mother died a horrible, long death.  And I always thought because of that, you know... that nothing else bad could ever happen to me.
(Harper cries harder and Olivia reaches over and hugs her) (scene fades)
